Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Kadrum AI photo generation service ("Service"), operated by Iurii Grinko, Sole Proprietor (registered in the Republic of Armenia, TIN: 73066131, address: Babayan 38, apt. 37, Yerevan, Armenia), via the Telegram bot at https://t.me/KadrumProBot ("Bot") and the website https://kadrum.pro ("Website").

By starting the Bot (pressing /start) or using the Service in any way, you agree to be bound by these Terms. If you do not agree, please stop using the Service immediately.

2. About the Service

2.1 What Kadrum Does

Kadrum is an AI-powered platform that allows users to generate and edit images using artificial intelligence. Features include AI photo sessions and other image generation and editing capabilities as available in the Bot interface.

2.2 Nature of the Service

The Service is a creative and entertainment tool for experimenting with visual content. It is not professional software and is not intended for identity verification, biometric purposes, creation of official or legally binding materials, or any tasks requiring guaranteed accuracy and reproducibility of results.

2.3 Changes to the Service

We reserve the right to modify, update, or discontinue any features or capabilities of the Service at any time. The current description of available features is displayed in the Bot interface.

3. Accounts and Access

3.1 Eligibility

You must have a valid Telegram account and internet access to use the Service. You must be at least 18 years of age to use the Service.

3.2 Trial Access

New users may receive a limited number of free trial generations. The terms and availability of trial access are determined at our sole discretion and may change at any time.

3.3 Account Responsibility

You are responsible for all activity that occurs through your Telegram account in connection with the Service. You must not share, transfer, or sell access to your account or purchased token packs.

4. Token Packs and Payments

4.1 Token Packs

The Service operates on a token-based model. Users purchase token packs containing a set number of tokens ("Tokens"). Tokens are digital goods with no intrinsic monetary value. They represent a prepaid right to use the Service's generation features. Purchased Tokens have no expiration date but may be discontinued if the Service is terminated (see Section 11).

4.2 How Tokens Work

Tokens are deducted automatically when you perform operations in the Bot. The number of Tokens required for a specific operation is displayed in the Bot interface before you confirm the operation.

4.3 Payments and Billing

All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all purchases. Paddle handles billing, payment processing, tax collection, invoicing, and refunds. By making a purchase, you also agree to Paddle's Terms of Use and Privacy Policy.

Prices, available packs, and payment methods are displayed in the Bot interface and may vary by region. When a user initiates a purchase, they are directed to a secure web-based checkout page powered by Paddle, where the payment is completed in a standard browser environment.

4.4 No Automatic Renewal

Token pack purchases are one-time transactions. There is no automatic renewal or recurring billing unless explicitly stated and separately consented to by you.

5. Refunds

5.1 Refund Policy

Tokens are digital goods. The following refund policy applies:

• Unused token pack (no Tokens spent): You may request a full refund within 14 calendar days of purchase.
• Partially used token pack (one or more Tokens spent): No refund is available.
• Fully used token pack: No refund is available.

5.2 How to Request a Refund

Since Paddle acts as the Merchant of Record, all refund requests are processed through Paddle. To initiate a refund, please contact us at support@kadrum.pro, and we will coordinate with Paddle on your behalf.

6. Acceptable Use

6.1 You Agree Not To

When using the Service, you must not:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
• Upload or create content that promotes violence, extremism, terrorism, or hatred;
• Generate, upload, or distribute sexually explicit, pornographic, or otherwise adult content (NSFW);
• Upload or create content that violates intellectual property rights, privacy rights, or other rights of third parties;
• Create misleading or deceptive content, including but not limited to fake documents, fabricated evidence, or content intended to deceive others about its origin or authenticity;
• Create deepfakes or manipulated media depicting real individuals without their explicit consent;
• Generate images of public figures, politicians, or celebrities;
• Create content intended for political manipulation, disinformation campaigns, or election interference;
• Create content that may harm, defame, or damage the reputation of any person;
• Attempt to reverse-engineer, decompile, or otherwise extract the underlying algorithms or models of the Service;
• Use the Service for any automated, bulk, or commercial scraping, or to build competing products;
• Circumvent any technical limitations or access restrictions of the Service.

6.2 Photo Upload Policy

You may only upload photos of yourself or photos of other individuals for whom you have obtained explicit consent. By uploading any photo, you represent and warrant that you have the legal right to use it and that all individuals depicted have given their permission. We reserve the right to review, moderate, and remove any content that violates these Terms, and to suspend or terminate accounts engaged in misuse.

6.3 Your Responsibility

You are solely responsible for ensuring that any photos, images, or other materials you upload to the Service comply with applicable laws, including obtaining any necessary consents from third parties depicted in such materials.

6.4 Enforcement

We may restrict, suspend, or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. In cases of serious or repeated violations, unused Tokens may be forfeited without compensation.

7. AI-Generated Results

7.1 No Guarantee of Results

AI generation is probabilistic by nature. Results may contain artifacts, distortions, inaccuracies, or other imperfections. We do not guarantee that any generated image will meet your expectations in terms of quality, style, likeness, or any other criteria.

7.2 Subjective Dissatisfaction

Subjective dissatisfaction with results (e.g., "doesn't look like me," "wrong style," "low quality") does not constitute a defect in the Service and is not grounds for a refund or claim.

8. Intellectual Property

8.1 Our Rights

All rights to the Service, including its interface, design, code, algorithms, databases, and documentation, belong to us or are used under valid licenses.

8.2 Your Content

You retain rights to content you create using the Service (generated images), including for commercial use, subject to any applicable third-party rights and legal restrictions. You are solely responsible for how you use and distribute generated content.

8.3 Uploaded Materials

You represent and warrant that you have the right to upload any photos or materials to the Service and that such use does not infringe on any third-party rights.

9. Data and Privacy

9.1 What We Collect

In order to provide the Service, we may collect and process the following data:

• Telegram user ID and username;
• Photos and text descriptions you submit to the Bot;
• Operation history (generation records, pack usage);
• Technical data related to your interaction with the Bot.

9.2 How We Use Your Data

Your data is used solely for the purpose of providing and improving the Service, including processing your generation requests, managing your account, and providing customer support.

9.3 Data Storage

Your data is stored on servers located in Germany (EU). We implement reasonable technical and organizational measures to protect your data, but you acknowledge that no method of transmission over the internet is fully secure.

9.4 Data Deletion

You may request deletion of your uploaded materials and/or generated results at any time by contacting support@kadrum.pro.

9.5 Communications

You may receive messages through the Bot related to the Service, including service updates, support notifications, promotional offers, and marketing communications. You can opt out of promotional and marketing messages at any time by contacting support@kadrum.pro.

10. Limitation of Liability

10.1 We Are Not Liable For

To the maximum extent permitted by law, we shall not be liable for:

• Results not meeting your expectations, including likeness, style, quality, or other subjective criteria;
• Any consequences arising from your use or distribution of generated content, including third-party claims;
• Your violations of third-party rights;
• Temporary outages, service interruptions, or limitations in access to Telegram or the internet;
• Actions or failures of third-party services, including payment processors.

10.2 Disclaimer

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

10.3 Maximum Liability

To the extent permitted by applicable law, our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for the token pack giving rise to the claim.

11. Termination

11.1 Termination by You

You may stop using the Service at any time. If you wish to delete your account and all associated data, you may submit a request to support@kadrum.pro. Upon account deletion, any remaining unused Tokens will be forfeited and are not refundable (except as provided in Section 5.1).

11.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other reason at our sole discretion. In cases of termination for violation, unused Tokens may be forfeited without compensation.

11.3 Service Discontinuation

If we discontinue the Service entirely, we will make reasonable efforts to notify users in advance so they may use their remaining Tokens. Any unused Tokens remaining after the Service is discontinued will be forfeited, unless a refund is requested in accordance with Section 5.

12. Changes to These Terms

We may update these Terms at any time. The current version will be published on our Website and/or in the Bot. Continued use of the Service after changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Armenia.

13.2 Dispute Resolution

We encourage you to contact us first at support@kadrum.pro to resolve any issues informally. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of the Republic of Armenia.
